Martinez, et al. v Irwin Industries, et al.


Multiple plaintiffs alleged serious physical and emotional injuries resulting from an explosion of a gas heater at a petroleum refinery.   Plaintiffs collectively sought damages in excess of one million dollars.  Plaintiffs filed a negligence and products liability suit against our client, the installer of the heater, as well as seven other defendants.  Following in-depth client interviews, review of tens of thousands of pages of complex documents, and rigorous cross examinations of all plaintiffs, we proved that our client installed the heater according to the plans and specifications in a good and workmanlike manner and did not alter the design, as alleged by plaintiffs.  In turn, plaintiffs collectively dismissed their complaints against our client with prejudice for a waiver of costs.  The court approved our application for a good faith settlement, which bared any other joint tortfeasor or co-obligor from any claims against our client for equitable comparative contribution, or partial or comparative indemnity, based on comparative negligence or comparative fault.
