This wrongful death and survival action arose from a commercial vehicle accident in Ventura County. Plaintiffs alleged that defendant driver was towing a concrete mixer, allegedly manufactured by our client. The axle of the mixer allegedly detached and hit decedent’s car, causing the accident and fatal injuries. Defendants also filed a cross complaint against our client for indemnity and contribution. Through our extensive research, client interviews, and discovery, we established that our client did not design, manufacture, and/or sell the mixer, nor did our client assume the liabilities of the manufacturer, designer or retailer of the mixer. In turn, plaintiffs and cross complainants agreed to dismiss our client from their complaint and cross-complaints with prejudice for waivers of costs.
