Romon v Insomniac, Inc. et al.


We moved for summary judgment on behalf of our client, event promoter Insomniac, Inc. Plaintiff claimed a serious head injury from falling down stairs at the Coliseum while attending a concert-type event, asserting he was suddenly and unexpectedly pushed or bumped. He sued the event promoter, as well as the security provider and others, asserting crowd control measures were insufficient thereby allowing him to be bumped. Defendants asserted that they did not owe a duty to plaintiff for the unexpected touching, as it was not reasonably foreseeable and plaintiff was merely speculating that an act or omission of defendants caused his fall. The Court agreed with defendants and granted summary judgment. Plaintiff filed a Notice of Appeal but never filed an Opening Brief and the appeal was dismissed.
